    Beijing Cheng Guangxin expert support service agreement

    This service agreement is sincere guangxin Beijing intellectual property agency co., LTD. (referred to as "honesty" guangxin) between with you, for you and/or the third party you represent, through the use of cheng guangxin expert auxiliary application services (hereinafter referred to as "the services"), for application for trademark registration effective contracts concluded related matters.

    This Service Agreement will be in bold or underlined form to remind you to pay special attention to the restrictions, disclaimer, the determination and treatment of your violations and breaches, and the choice of the jurisdiction of the court, etc., you should pay special attention to read.

    1. Definition and Interpretation
      1. Trademark applicant: refers to the subject of trademark registration application to the Trademark Office, including legally established enterprises, institutions, social organizations, individual businesses, individual partnerships and foreigners or foreign enterprises in accordance with the Provisions of the Trademark Law. The trademark applicant may be you or someone else who has entrusted you to file the application on your behalf.
      2. All terms and terms involved in the application process, such as: trademark office, trademark registrant, acceptance, rejection, etc., shall be subject to the relevant definitions and interpretations in the Trademark Law of the People's Republic of China, trademark laws and regulations, and trademark administrative departments.
    2.  Service Content

    2.2 This service will be provided by Beijing Chengguangxin Intellectual Property Agency Co., LTD. Therefore, your contact information, demand information will be provided to Beijing Chengguangxin; In the process of service, service experts will contact you for specific communication, to assist you in trademark registration application, including: trademark search and success rate analysis, trademark modification suggestions, help to formulate trademark plan, help to prepare application materials, trademark application feedback and suggestions, etc.

    2.3 You understand and agree that the success of your trademark registration application submitted through the expert assistance application service of Chengguangxin depends on the trademark mark itself and the application time and other factors, and the final decision will be made by the Trademark Office after the examination in accordance with the law. Beijing Chengguangxin will not guarantee the success of your trademark registration application in any express or implied way, and the success of your trademark registration application is not responsible for the law has been clearly provided for. If you require a 100% success rate, Beijing Chengguangxin cannot make a commitment, so please carefully consider whether to continue to use the service.

    2.4 The application service is a single service, which only refers to the trademark registration application service. If you need to file a reexamination of rejection or reply to objections in the process of trademark examination, or if you need to change the mark of the trademark that has been applied for registration, you shall purchase the corresponding other services of Beijing Chengguangxin.

    1. Service Usage Specifications

    3.1 You understand and warrant that:

    3.1.1 You shall be responsible for the authenticity and accuracy of the information and materials provided during the use of the Service; If you intentionally or negligently cause such information error, you shall bear all the responsibility and consequences.

    3.1.2 You should to cheng guangxin provide complete and accurate and reliable connection way (including but not limited to mobile phone number, email, address or other contact details available), such as service in the process of change your contact information, you should inform Beijing sincere letter, so as not to affect the service information and files in the process of communication. Any result caused by inaccurate contact information shall be borne by you.

    3.2 You understand and warrant that:

After the application for trademark registration has been submitted to the Trademark Office, the fees collected are not refundable, regardless of whether the trademark has been successfully registered.     1. Cheng Guangxin service commitment

    4.1 Chengguangxin and the partners will work together to provide you with the service content agreed in this service Agreement and assist you to complete the relevant procedures of trademark registration application. Professional staff will provide you with whole-process consultation, trademark search and success rate analysis, trademark modification suggestions, assist in the formulation of trademark scheme, assist in the preparation of application materials, trademark application feedback and suggestions and other manual services.

    4.2Chengguangxin will take security measures to protect your personal information and trademark application related information. Without your consent, Chengguangxin will not disclose or transfer your business information, intellectual property information or personal information involved in the service to any third party and will not be used for purposes other than the Service, except in the following circumstances:

    4.2.1 Because the information is known to others through other channels other than CGT, such channels are not restricted by the obligation of confidentiality;

    1. Force Majeure and liability

    5.1 If the trademark registration application fails due to the fault of Chengguangxin, the upper limit of chengguangxin's liability is to refund the fees you have paid for the expert assistance application service. Chengguangxin shall not be liable for any other direct or indirect losses, loss of business opportunities, loss of profits, infringement, other intangible losses or losses you may suffer based on the contracts you have signed with others.

    5.2 If there are other provisions in this Service Agreement regarding liability, such provisions shall prevail.

    1. Governing law and dispute resolution

     6.1 You understand and agree that any dispute between you and CHENGguangxin regarding the expert assistance application service provided by Chengguangxin for you shall be settled by the parties through friendly consultation.

    6.2 If the negotiation fails, both parties agree to file a lawsuit to the people's court with jurisdiction in the main business location of Beijing Chengguangxin.
